Residents Challenge MHADA Tender Process in Bombay High Court

Winner names for the three MHADA cluster redevelopments were declared on June 2, 2026, even as resident groups and housing societies from the three areas waited for a Bombay High Court hearing on June 9 to challenge the tender process. Scale and Scope of the Redevelopment

Adani Properties was declared the highest bidder for Bandra Reclamation, spread over 98.27 acres, and the Adarsh Nagar colony in Worli, spread over 34.33 acres. The two projects combined cover approximately 132.6 acres of land in West Mumbai and Central Mumbai.

MHADA had built 56 affordable housing colonies between 1950 and 1960 for middle-income and lower-income groups, comprising around 5,000 housing societies, with several buildings having deteriorated over time and requiring redevelopment.

Nature of the Petition

Cooperative housing societies from Adarsh Nagar in Worli approached the Bombay High Court challenging the Maharashtra government's decision to undertake cluster redevelopment of MHADA layouts at Adarsh Nagar and Bandra Reclamation, contending that the policy unlawfully takes away their redevelopment and property rights.

The petitioner societies argued that the Government Resolutions violated Article 300A of the Constitution by depriving them of their property rights without following due process of law, and that the policy compelled societies to join cluster redevelopment, thereby taking away their right to pursue independent redevelopment.

State's Position and Competing Interests

MHADA's Senior Advocate argued that only a small number of the nearly 5,000 affected housing societies had challenged the policy, and that setting aside the Government Resolutions and the tender process would adversely affect numerous other societies and residents awaiting redevelopment.

During earlier hearings in May, the High Court had declined to stay the tender process after the state submitted that redevelopment of the 50 to 60-year-old buildings was necessary to improve residents' living conditions, observing that allowing the tender process to continue would not prejudice the petitioners.

The Competitive Bid Process

Lodha Developers and JSW bid for Bandra Reclamation, and Reliance 4IR Realty Development was among the bidders for SVP Nagar. The tender concluded with financial bids being opened after technical evaluations.

The accepted bids were to be placed before a high-powered committee, after which they would be forwarded to the state government for final clearance.

The tender award to Adani Properties covers the MHADA cluster redevelopment spanning 98.27 acres at Bandra Reclamation. This redevelopment is distinct from Adani Realty's private 24-acre luxury project also located in Bandra Reclamation, known as Adani Bandra West, which is separately proceeding as a mixed-use township development.

Broader Context

MHADA is undertaking 11 major redevelopment projects under the Construction and Development Agency model across nearly 925 acres in Mumbai, expected to benefit more than 80,000 residents living in ageing colonies constructed decades ago. The tender awards announced in June 2026 represented a significant phase of this larger urban renewal program.
